- Kompaan: Kompaan Dutch Craft Beer Company.
- Abonnee: de consument die een abonnement afsluit.
- Abonnement: een overeenkomst waarbij de abonnee periodiek een box met bieren ontvangt.
- Latest ‘N Greatest: het maandelijkse bierabonnement van Kompaan.
- Specials Only: het tweemaandelijkse bierabonnement van Kompaan.
- Abonnementsperiode: de overeengekomen duur van het abonnement.
Totstandkoming van het abonnement
- Abonnementen worden afgesloten via de website van Kompaan.
- Een abonnement komt tot stand zodra Kompaan de inschrijving heeft bevestigd en de eerste reguliere abonnementsbetaling is geslaagd.
- Inschrijving voor een komende leveringsperiode is mogelijk tot en met de laatste dag van de maand voorafgaand aan de levering.
Abonnementen & prijzen
Latest ‘N Greatest
- Maandelijks opzegbaar: €45 per maand
- 6 maanden: €42,50 per maand
- 12 maanden: €40 per maand
Levering: maandelijks.
Specials Only
- Tweemaandelijks opzegbaar abonnement: €49,50 per levering
- Levering: eenmaal per twee maanden
Betaling
- Betaling van het abonnement vindt plaats via het bij inschrijving gekozen betaalmiddel.
- Bij het afsluiten van het abonnement wordt een eenmalige verificatiebetaling van €0,01 uitgevoerd ter controle van het opgegeven betaalmiddel.
- De abonnementskosten worden vooraf geïncasseerd op de laatste dag van de maand voorafgaand aan de maand waarin de levering volgens het gekozen abonnement plaatsvindt.
- De afschrijving heeft steeds betrekking op de aankomende leveringsperiode.
- Indien een betaling niet succesvol kan worden geïncasseerd, zal Kompaan maximaal vijf (5) nieuwe pogingen doen om de betaling alsnog te laten slagen, verdeeld over een periode van zeven (7) dagen.
- Indien na deze pogingen geen succesvolle betaling heeft plaatsgevonden, wordt het abonnement op ‘in de wacht’ (on hold) gezet. Zolang het abonnement deze status heeft, worden geen leveringen verzonden.
- Zodra de openstaande betaling alsnog is voldaan, wordt het abonnement hervat. Gemiste leveringen worden niet met terugwerkende kracht verzonden, tenzij Kompaan anders beslist.
Pauzeren
- Abonnementen kunnen worden gepauzeerd via het gebruikersaccount.
- Pauzeren dient uiterlijk vóór de laatste dag van de maand te gebeuren om effect te hebben op de eerstvolgende levering volgens het abonnement.
- Een abonnement kan niet voor twee opeenvolgende leveringsperiodes worden gepauzeerd.
- Latest ‘N Greatest-abonnementen met een looptijd van 6 of 12 maanden kunnen eenmaal per abonnementsperiode worden gepauzeerd.
- Pauzeren geldt steeds voor één leveringsperiode.
- Na een pauze wordt het abonnement automatisch hervat of kan het handmatig worden hervat via het gebruikersaccount.
Levering
- Levering vindt plaats in de eerste week van de leveringsmaand.
- De abonnementskosten zijn inclusief verzending, tenzij anders vermeld.
- Het risico van beschadiging of verlies blijft bij Kompaan tot het moment van feitelijke ontvangst door de abonnee.
- Bij schade of vermissing wordt de abonnee verzocht contact op te nemen via bestelling@kompaanbier.nl, zodat Kompaan kan zoeken naar een passende oplossing.
- Bij aflevering wordt een leeftijdscontrole (18+) uitgevoerd.
Inhoud van de box
- De inhoud van de Latest ‘N Greatest box kan variëren per periode en wordt door Kompaan Dutch Craft Beer Company zorgvuldig samengesteld.
- Elke Latest ‘N Greatest box bevat een variërende selectie van 9 tot 11 blikken met een mix van nieuwe releases aangevuld met Core-range of overige bieren en kan sporadisch worden aangevuld met merchandise en verrassingen.
- Elke Specials Only box bevat een selectie van 8 tot 10 blikken met de nieuwe releases van die periode en kan sporadisch worden aangevuld met merchandise en verrassingen.
Herroepingsrecht
- De abonnee heeft het recht de abonnementsovereenkomst binnen 14 dagen na ontvangst van de eerste levering zonder opgave van redenen te herroepen.
- Het herroepingsrecht is uitsluitend van toepassing op de eerste levering binnen het abonnement en geldt niet opnieuw bij vervolgleveringen.
- Indien de abonnee gebruikmaakt van het herroepingsrecht nadat de eerste box is ontvangen, dient deze ongeopend en in originele staat te worden geretourneerd.
- Indien de verzegeling is verbroken, vervalt het herroepingsrecht wegens de aard van de geleverde producten.
- Na correcte herroeping zal Kompaan het eventueel betaalde bedrag binnen 14 dagen restitueren.
Opzegging en automatische verlenging
- Maandelijks en tweemaandelijks opzegbare abonnementen kunnen op elk moment worden opgezegd via het gebruikersaccount.
- 6- en 12-maandsabonnementen kunnen gedurende de abonnementsperiode op elk moment worden opgezegd via het gebruikersaccount. De opzegging gaat in na afloop van de overeengekomen abonnementsperiode.
- Indien een 6- of 12-maandsabonnement niet uiterlijk vóór het einde van de abonnementsperiode is opgezegd, wordt het abonnement na afloop van deze periode automatisch verlengd voor onbepaalde tijd en is het daarna maandelijks opzegbaar via het gebruikersaccount.
- Vroegtijdige beëindiging van een 6- of 12-maandsabonnement is uitsluitend mogelijk tegen afkoop, waarbij de resterende termijnen geheel of gedeeltelijk in rekening kunnen worden gebracht. Hiervoor kan contact worden opgenomen via het contactformulier in het gebruikersaccount.
Leeftijdscontrole en alcohol
- Abonnementen zijn uitsluitend beschikbaar voor personen van 18 jaar en ouder.
- Abonnees verklaren bij het afsluiten van het abonnement te voldoen aan de wettelijke leeftijdsvereisten voor alcoholconsumptie.
- Ter naleving van de Alcoholwet laat Kompaan de leeftijdscontrole bij levering uitvoeren door de vervoerder (PostNL).
- De bezorger controleert bij aflevering of de ontvanger 18 jaar of ouder is en kan om een geldig legitimatiebewijs vragen.
- Indien bij levering niet kan worden vastgesteld dat de ontvanger 18 jaar of ouder is, wordt de levering geweigerd en geretourneerd.
- Eventuele kosten of vertragingen als gevolg van een geweigerde leeftijdscontrole kunnen aan de abonnee worden doorberekend.
- Kompaan behoudt zich het recht voor het abonnement te beëindigen indien blijkt dat onjuiste leeftijdsgegevens zijn verstrekt.
Aansprakelijkheid
- De aansprakelijkheid van Kompaan is beperkt tot het bedrag van de betreffende levering voor zover wettelijk toegestaan.
- Kompaan is niet aansprakelijk voor indirecte schade, tenzij sprake is van opzet of grove nalatigheid.
Wijziging voorwaarden
- Kompaan Dutch Craft Beer Company behoudt zich het recht voor deze algemene voorwaarden te wijzigen.
- Wijzigingen worden voorafgaand aan de inwerkingtreding aan de abonnee gecommuniceerd.
- Indien een wijziging naar het redelijk oordeel van Kompaan leidt tot een wezenlijk nadeel voor de abonnee, heeft de abonnee het recht het abonnement kosteloos op te zeggen.
Toepasselijk recht
Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.
